Platform role, accounts and payments

Eligibility. You must be at least 18 years old to create an account, host a group buy, join a group buy or otherwise transact through Bundl. By using Bundl, you represent that you are at least 18 and legally capable of entering into these Terms.

Bundl currently operates for users and group buys in Singapore only.

Bundl's role. Bundl provides software that enables users to organise group buys, submit order and fulfilment information, communicate relevant transaction information and maintain group buy records.

Unless Bundl expressly identifies itself as the seller in a particular transaction, Bundl is not the retailer or seller of goods listed through a group buy, does not take title to those goods, does not purchase them from the retailer on a Buyer's behalf, and is not the courier or delivery provider.

Depending on how a group buy is arranged, the relevant sale or purchasing relationship may be between the Buyer and Host, between the Host and an underlying retailer, or otherwise involve a third-party retailer. The Host must accurately explain the arrangement where this is material to Buyers. Bundl is not a party to the contract for the underlying goods merely because the group buy was organised through the Platform.

Accounts. You must provide accurate account information, keep your login credentials confidential and take reasonable steps to prevent unauthorised use of your account. You must notify Bundl promptly if you reasonably believe that your account has been compromised.

You may not create accounts using another person's identity without authority, impersonate another user or transfer an account in a way that misleads Bundl or other users.

Payments. Buyers pay Hosts directly using the payment method specified by the Host. Bundl does not receive, hold or safeguard Buyers' purchase money on behalf of Hosts and does not settle those payments between users.

Bundl may display a Host's PayNow, PayLah or other payment instructions and may allow information or evidence relating to payment to be recorded on the Platform, but this does not make Bundl the recipient of the payment.

Hosts must clearly disclose the amounts a Buyer is expected to pay, including reasonably foreseeable delivery, shipping or other charges and, where an amount is variable, the method by which it will be determined. Hosts must not impose undisclosed charges or make misleading representations regarding price, discounts, availability, specifications or other material transaction information.

Host and Buyer responsibilities and prohibited use

Hosts. A Host is responsible for the group buy that the Host creates or operates. The Host must:

1. provide accurate and sufficiently complete information about the goods, source or retailer, prices, quantities, closing dates, fulfilment method, payment instructions and material restrictions or conditions;
2. clearly disclose material additional or variable charges;
3. process accepted orders and payments honestly and in accordance with the information given to Buyers;
4. communicate material changes, cancellations, shortages or fulfilment problems within a reasonable time;
5. handle refunds or amounts owed by the Host directly with the affected Buyer;
6. comply with applicable Singapore laws concerning the goods and the Host's activities, including consumer-protection and product-safety requirements where applicable; and
7. not make false or misleading claims concerning a product's authenticity, origin, availability, price, quality, safety, characteristics or endorsement.

Buyer personal data received by Hosts. A Host who receives a Buyer's name, contact information, address, order information, payment evidence or other personal data through Bundl must:

• use the information only for purposes reasonably connected with that group buy, including payment, ordering, fulfilment, delivery, collection, refunds and genuine disputes;
• take reasonable steps to protect it from unauthorised access or disclosure;
• not sell it, publish it, use it for unrelated marketing or add the Buyer to an unrelated marketing list without a lawful basis;
• disclose it to others only where reasonably necessary for the group buy or required by law; and
• cease retaining it when it is no longer reasonably required for the transaction, a dispute, or another legitimate legal or business purpose.

Where a Host handles personal data as an “organisation” for purposes of the PDPA, the Host is independently responsible for complying with the PDPA.

Buyers. A Buyer must provide accurate order, contact, payment and fulfilment information; review the Host's listing and payment instructions before submitting an order; pay the correct recipient using the stated method; and promptly contact the Host about errors, cancellations or fulfilment problems.

A Buyer must not submit false proof of payment, false delivery evidence or other fabricated information.

User content. You remain responsible for text, images, screenshots and other material you upload. You must have the right or lawful basis to submit that content and must not upload material that unlawfully infringes another person's intellectual-property, confidentiality, privacy or other rights.

You grant Bundl a non-exclusive licence to host, copy, process, transmit and display your submitted content only to the extent reasonably necessary to operate Bundl, provide the relevant group-buy functionality, maintain appropriate records, protect the Platform and comply with law.

Prohibited goods and activities. You must not use Bundl to list, organise, purchase, promote or facilitate:

• goods or services whose sale, possession, supply or import is unlawful in Singapore;
• counterfeit, stolen or unlawfully infringing goods;
• weapons, explosives or other inherently dangerous goods prohibited or restricted by law;
• controlled drugs, unlawful vaping products or other controlled or prohibited substances;
• unsafe or recalled consumer goods, or regulated goods supplied without legally required approvals or compliance;
• obscene or sexually explicit goods or content prohibited by law;
• fraudulent schemes or transactions;
• goods obtained through crime or transactions intended to facilitate money laundering or other criminal activity; or
• any other goods, services or activity that Bundl reasonably considers unlawful, dangerous or inconsistent with the safe operation of the Platform.

This list is not exhaustive.

You also must not use Bundl to harass or threaten another person, collect users' personal information for unrelated purposes, send malware, interfere with the Platform, evade access controls, obtain unauthorised access to another account or order, scrape restricted personal information, manipulate Platform records or use Bundl for fraudulent or deceptive conduct.

Bundl may remove a listing or content, prevent a group buy from proceeding, restrict functionality, suspend or terminate an account, or preserve relevant records where we reasonably believe this is necessary to enforce these Terms, protect users or the Platform, investigate suspected misconduct or comply with law. Where appropriate, we may cooperate with law-enforcement or regulatory authorities.

Disputes, service limits, changes and governing law

Orders, cancellations and refunds. Hosts must state any material cancellation or refund conditions applicable to their group buys and must comply with applicable law. Where an order is subject to an underlying retailer's cancellation, return or refund policy, the Host should make material restrictions reasonably clear to Buyers.

Because Bundl does not hold transaction funds, a refund payable by a Host must ordinarily be made directly by that Host to the relevant Buyer. Bundl may provide records or tools intended to help users communicate or resolve a dispute, but Bundl is not required to determine the legal merits of a dispute between users.

Third-party goods and services. Bundl does not control the manufacturing, quality, authenticity, safety, legality, stock availability or delivery performance of goods or services supplied by Hosts, retailers, couriers or other third parties.

To the extent permitted by law, Bundl is therefore not responsible merely because:

• a retailer runs out of stock or changes its price;
• a Host does not obtain an item;
• an item differs from the Host's or retailer's representation;
• a payment dispute arises directly between a Buyer and Host;
• delivery or collection is delayed by a Host, retailer or courier; or
• a third-party product is defective, unsafe or otherwise unsatisfactory.

Platform availability. We aim to keep Bundl available and secure, but we do not guarantee that every feature will be uninterrupted or error-free. We may maintain, modify, discontinue or restrict Platform features where reasonably necessary for technical, security, legal or operational reasons.

Privacy. Our collection, use, disclosure and protection of personal data is governed by the Bundl Privacy Policy above. Hosts and Buyers must also comply with the personal-data obligations imposed on them by these Terms.

Changes to these Terms. We may update these Terms to reflect changes to Bundl, our practices or applicable law. We will publish the revised Terms and their effective date and will provide reasonable notice where changes are material. Changes apply prospectively. Where applicable law requires a more specific form of agreement or notice, we will comply with that requirement.

Termination. You may stop using Bundl and request account closure at any time, subject to outstanding group buys, transaction records and information that may lawfully need to be retained. Bundl may suspend or terminate access where reasonably necessary because of a serious or repeated breach of these Terms, unlawful activity, fraud, security risk, risk to another user or a legal or regulatory requirement.

Terms that by their nature need to continue after termination, including provisions relating to completed transactions, privacy, user content already lawfully retained, disputes and applicable law, remain effective to the extent necessary.

Severability. If a provision of these Terms is found unlawful or unenforceable, it will be applied to the maximum extent legally permitted, and the remaining provisions will continue to apply.

Governing law. These Terms and disputes relating to Bundl are governed by the laws of Singapore. The parties submit to the jurisdiction of the Singapore courts, subject to any mandatory statutory right to bring a claim before another competent tribunal or forum.
